ECLOSION S.A.S., tax ID (NIT) 830.136.430-1, domiciled at Calle 98 A # 51-37, Oficina 302, Bogotá D.C., Colombia (“Eclosion IT”), publishes these Terms and Conditions governing access to and use of the website www.eclosionit.com (the “Site”). This is a courtesy translation; the Spanish version prevails.
1. Acceptance
By accessing and using the Site, you (the “User”) confirm that you have read, understood and accepted these Terms and our Privacy and personal data policy. If you do not agree, please do not use the Site.
2. Purpose of the Site
The Site is informational and commercial: it presents Eclosion IT’s services in custom software development, integrations and APIs, AI integration, IT consulting, Odoo implementation and support, data migration and related services, and enables contact with prospective clients.
Published information is general and is not a binding offer. The terms of each service (scope, deliverables, schedule, price, warranties and service levels) are defined in the commercial proposal, service order or contract signed with each client, which prevail over these Terms where they conflict.
3. Acceptable use
The User agrees to:
- Use the Site in accordance with the law, public order and these Terms.
- Provide truthful, complete and up-to-date information in contact forms.
- Not damage, overload or disable the Site, nor attempt unauthorized access to its systems or those of third parties.
- Not introduce viruses, malicious code or anything that compromises the security of the Site or other users.
- Not use automated means to submit forms in bulk.
4. Intellectual property
The ECLOSION IT® name, symbol and logo are registered trademarks of ECLOSION LTDA. and ECLOSION IT®. The texts, designs, graphics, source code and other content of the Site belong to Eclosion IT or are used with permission, and are protected by Colombian Law 23 of 1982, Andean Decision 351 of 1993 and other copyright and industrial property rules.
Reproduction, distribution, public communication or transformation without prior written permission from Eclosion IT is prohibited. Odoo® is a registered trademark of Odoo S.A.; it is mentioned on the Site to describe the services Eclosion IT provides as a partner.
Ownership of software developed for clients is governed by the respective contract.
5. Third-party links
The Site may link to third-party websites (e.g., social networks or Odoo documentation). Eclosion IT does not control and is not responsible for their content, policies or practices.
6. Limitation of liability
Eclosion IT strives to keep the Site accurate and up to date but does not guarantee it is free of errors or omissions or uninterruptedly available. To the extent permitted by law, Eclosion IT is not liable for damages arising from the use of or inability to use the Site, or for decisions based solely on the general information published here.
7. Consumer protection
Where applicable, the relationship between Eclosion IT and the User is governed by Colombian Law 1480 of 2011 (Consumer Statute) and Law 527 of 1999 on e-commerce. Requests, complaints and claims may be sent to sgarzon@eclosionit.com.
8. Personal data
Personal data provided through the Site is processed under our Privacy and personal data policy, in accordance with Colombian Law 1581 of 2012 and its regulations.
9. Changes
Eclosion IT may change these Terms at any time. Changes take effect when published on the Site, with the last-updated date shown.
10. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Bogotá D.C., without prejudice to alternative dispute resolution mechanisms agreed by the parties. In case of discrepancy, the Spanish version prevails.
